Weslaco Concrete - Effective January 1, 2026
By accessing or using the website concreteweslaco.com (the "Site"), or by engaging Weslaco Concrete ("Company," "we," "us," or "our") to provide any concrete contracting services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Site or engage our services. These Terms apply to all visitors, customers, and others who access the Site or use our services.
Weslaco Concrete is a concrete contractor based in Weslaco, TX. We provide residential and commercial concrete services in Weslaco and surrounding communities in the Rio Grande Valley, including driveways, patios, slabs, foundations, sidewalks, pool decks, retaining walls, decorative concrete, and related work.
All services are subject to a written agreement or estimate signed by both parties before work begins. The scope of work, materials, and pricing are defined in that written agreement. Nothing on this Site constitutes an offer or binding commitment to provide services at any particular price.
Estimates provided by Weslaco Concrete are based on information available at the time of the site visit and are valid for 30 days from the date issued unless otherwise stated in writing. Estimates are not guaranteed final prices.
The final price may change if conditions discovered during the project differ materially from those observed during the estimate visit - for example, unexpected subsurface conditions, changes to the agreed scope of work, or material cost changes beyond our control. We will notify you in writing before proceeding with any change that affects the project price.
All price quotes are in U.S. dollars and do not include applicable permit fees unless explicitly stated in the written estimate.
Project start dates are scheduled after a written agreement is signed and any required deposit is received. Start dates are estimates and may shift due to weather conditions, permit processing delays, material availability, or other factors outside our control. We will notify you of any significant scheduling changes as promptly as possible.
Concrete work is weather-dependent. We reserve the right to reschedule a pour if conditions present a material risk to the quality of the finished work, including but not limited to rain, extreme heat, or strong wind. Rescheduling due to weather is not a breach of contract and does not entitle either party to cancellation fees.
If you wish to cancel a scheduled project, please notify us in writing as soon as possible. Deposits may be non-refundable if materials have been ordered or permits have been pulled on your behalf. Specific cancellation terms are stated in your written project agreement.
Payment terms are specified in your written project agreement. Typical terms include a deposit at contract signing and a final payment upon project completion. We accept payment by check, cash, or other methods as specified in your agreement.
Final payment is due upon substantial completion of the project. Withholding payment for minor punch-list items not yet addressed is not permitted - any outstanding items will be noted and resolved in a timely manner.
Accounts not paid within the terms specified in the written agreement may be subject to a late fee. Weslaco Concrete reserves the right to pursue collection through all available legal means for unpaid balances, including filing a mechanic's lien on the property where work was performed, as permitted under Texas law.
You agree to:
Failure to meet these responsibilities that results in damage, delay, or rework may be charged as an additional cost at our standard rates.
Weslaco Concrete warrants that work will be performed in a workmanlike manner consistent with industry standards for concrete contracting in Texas. Any warranty terms specific to your project will be stated in your written agreement.
Concrete is a natural material that may develop hairline cracks over time as it cures and as the ground beneath it shifts. Minor cracking that does not affect the structural integrity or intended use of the surface is not covered by workmanship warranty. Cracks resulting from expansive soil movement, tree root intrusion, improper use, or events outside our control (including freeze-thaw cycles and flooding) are likewise not covered.
The Site and all content on it are provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by Texas law, Weslaco Concrete shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services or this Site, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to a project shall not exceed the total amount you paid us for that specific project. This limitation applies regardless of the theory of liability - contract, tort, strict liability, or otherwise.
If a dispute arises between you and Weslaco Concrete, we encourage you to contact us directly first so we can try to resolve it informally. Most concerns can be addressed quickly with a direct conversation.
If informal resolution is not possible, the parties agree to attempt mediation before initiating any formal legal proceeding. The costs of mediation shall be shared equally unless the parties agree otherwise.
Any legal action that cannot be resolved through mediation shall be brought in the appropriate court of competent jurisdiction in Hidalgo County, Texas.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising under or related to these Terms shall be subject to the exclusive jurisdiction of the courts located in Hidalgo County, Texas.
Weslaco Concrete reserves the right to update or modify these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site or engagement of our services after any changes are posted constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.
